Website Terms
1. About This Website
This website (the “Website”) is operated by Trindade & Co. (“we”, “us”, “our”), [Company Legal Name], a company registered in [Country/Jurisdiction] under company number [Registration Number], with its registered office at 12 Old Bond Street, Mayfair, London W1S 4PW, United Kingdom. Our VAT registration number is [VAT Number, if applicable].
By accessing or using this Website, you agree to be bound by these Website Terms (“Terms”). If you do not agree to these Terms, please do not use this Website.
2. Eligibility
This Website and the products offered on it are intended for individuals who are at least 18 years old. By using this Website, you confirm that you meet this requirement.
3. Use of This Website
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this Website by any third party. You must not:
- Attempt to gain unauthorised access to any part of this Website, the server on which it is hosted, or any server, computer or database connected to it;
- Introduce viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful;
- Use any automated system, including “robots” or “spiders”, to access this Website for any purpose without our express written permission;
- Copy, reproduce, republish, or exploit any content on this Website for commercial purposes without our prior written consent.
4. Intellectual Property
All content on this Website — including but not limited to text, images, graphics, logos, the Trindade & Co. name and marks, design architecture descriptions (including T-DAS-001 and T-DAS-002), photography, and page layouts — is the property of Trindade & Co. or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing on this Website grants you any licence or right to use any trademark, logo, or other proprietary content without our prior written permission.
5. Products, Descriptions and Pricing
We make every effort to ensure that descriptions, specifications, and images of our timepieces are accurate. However:
- Certain references (for example, the Presidential Edition, Imperial Edition, and pieces within the Ladies’ Collection) may represent developing or forthcoming works, and details such as movement, complications, materials, and final configuration remain subject to change until confirmed through our engineering and validation process;
- Colours and finishes may vary slightly from images shown, due to photography, lighting, and individual display settings;
- We reserve the right to correct any pricing or descriptive errors, and to cancel any order affected by such an error, even after an order has been submitted.
6. Enquiries, Registrations of Interest, and Orders
Certain pieces on this Website are available to purchase directly; others are available only via “Register Your Interest” or “Private Consultation” requests, ahead of confirmed production or availability. Submitting a registration of interest, appointment request, or order through this Website does not guarantee allocation of a specific timepiece and does not constitute a binding contract of sale until confirmed by us in writing.
Where a direct purchase is completed through this Website, a contract is formed only once we have accepted your order (for example, by sending an order confirmation). We reserve the right to refuse or cancel any order at our discretion, including where a piece is unavailable, mispriced, or where we suspect fraudulent activity.
7. Payment
Payment must be made in full through the payment methods made available at checkout. By submitting payment details, you confirm that you are authorised to use the payment method provided. We use [Payment Processor Name] to process payments and do not store full card details on our own servers.
8. Delivery
Delivery timeframes, where provided, are estimates only. For made-to-order, limited edition, or reservation-based pieces, delivery is dependent on completion of our engineering and production process, and timeframes will be communicated separately. Risk in the product passes to you upon delivery; ownership passes once payment has been received in full.
9. Cancellation, Returns and Refunds
If you are a consumer purchasing from within the United Kingdom or European Union, you generally have a statutory right to cancel a distance-sale order within 14 days of delivery, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or equivalent). To exercise this right, contact us using the details in Section 14.
This right may not apply to timepieces that are made to order, personalised, or produced in limited/numbered editions to your specification, to the extent permitted by applicable law. Any such exclusions will be made clear to you before you complete a purchase.
Where a return is accepted, the item must be returned unworn, in its original condition, packaging, and with all accompanying documentation (including certificates of authenticity and warranty cards). We reserve the right to inspect returned items before processing a refund.
10. Warranty
Timepieces sold through this Website are covered by the manufacturer’s warranty terms provided with the piece at the time of sale. This Website does not itself extend any warranty beyond what is stated in that documentation. Nothing in these Terms affects your statutory rights as a consumer.
11. Limitation of Liability
To the fullest extent permitted by law, Trindade & Co. shall not be liable for any indirect, incidental, or consequential loss arising from your use of this Website, including loss of profits, data, or goodwill. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
12. Indemnity
You agree to indemnify and hold Trindade & Co. harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your misuse of this Website or your breach of these Terms.
13. Third-Party Links
This Website may contain links to third-party websites, including social media platforms. We are not responsible for the content, accuracy, or practices of any third-party website, and inclusion of a link does not imply endorsement.
14. Privacy and Cookies
Our use of your personal data is described in our Privacy Policy, and our use of cookies is described in our Cookie Policy. Both form part of these Terms by reference.
15. Changes to These Terms
We may revise these Terms at any time. The updated Terms will take effect from the date of publication on this page. Your continued use of this Website following any changes constitutes acceptance of the revised Terms.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of this Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
